1. Introduction
These Terms of Service ("Terms") govern your use of Orbit Music Server ("Orbit," "the Software") provided by Cosmique ("we," "us," "our"). By downloading, installing, or using Orbit, you agree to be bound by these Terms.
2. License Grant
Trial License: We grant you a limited, non-exclusive, non-transferable license to use Orbit for evaluation purposes for thirty (30) days from initial installation. The Trial License includes full functionality.
Personal License: Upon purchase, we grant you a perpetual, non-exclusive, non-transferable license to use Orbit for personal, non-commercial purposes on devices you own or control, subject to the activation limits specified at purchase.
You may not:
- Redistribute, sell, lease, sublicense, or transfer the Software
- Modify, reverse engineer, decompile, or disassemble the Software
- Remove or alter any proprietary notices
- Use the Software for commercial purposes without a commercial license
- Circumvent license verification or copy protection
- Use the Software to provide services to third parties
3. Trial Period
The Trial Period begins upon first installation. During this period, you have access to all features. Upon expiration, some features become restricted until you purchase a license. Your library data will be preserved. Each user is entitled to one Trial Period.
4. Purchases and Payments
Current pricing is available on our website. Prices are in USD unless otherwise specified. Payments are processed by Paddle. Applicable taxes will be calculated at checkout. Upon payment, you will receive your license key via email.
5. Refund Policy
We offer a thirty (30) day money-back guarantee from date of purchase. Contact us at support@cosmique.io with your order number to request a refund. Upon refund, your license will be revoked and you must discontinue use of the Software.
6. Updates and Support
Your license includes free updates for the lifetime of the product. "Lifetime" refers to the active development life of the Software. We provide community support through documentation and forums. As self-hosted software, we do not guarantee uptime or performance.
7. Your Data
Orbit is self-hosted software. Your music files, library database, and personal data remain on your systems. The Software does not transmit your personal data to us. It may contact our servers or third-party services for license validation, updates, and metadata enrichment.
You are responsible for backing up your data, securing your installation, and complying with applicable laws regarding your music collection.
8. Intellectual Property
The Software is owned by Cosmique and protected by copyright and intellectual property laws. You retain all rights to your music files and data. If you provide feedback or suggestions, you grant us a perpetual, royalty-free license to use such feedback.
9. Disclaimers
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED. WE DO NOT GUARANTEE COMPATIBILITY WITH ANY SPECIFIC HARDWARE OR FORMATS. Metadata from third-party services is provided by those services without guarantee of accuracy.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE LICENSE.
11. Indemnification
You agree to indemnify and hold harmless Cosmique from any claims, damages, or expenses arising from your use of the Software, violation of these Terms, or violation of any third-party rights.
12. Termination
You may terminate your license at any time by deleting all copies. We may terminate your license if you violate these Terms. Termination does not entitle you to a refund except as provided in Section 5.
13. General Provisions
These Terms constitute the entire agreement between you and us. We may update these Terms; continued use after changes constitutes acceptance. You may not assign your license without our consent.
